            Creates the Oklahoma School Testing Program Review Task Force.  Will exist             until 12-31-10 to conduct a comprehensive review of the current student testing       system in Oklahoma.  Floor substitute delineates who members of TF will be.        Passed House, passed Senate, in conference, in Senate..

Adds as sponsors for charter schools:  districts on school improvement list, technical centers with schools on school improvement list, IHE that are located in district with school on school improvement list.  Removes cap of three new charter schools may be formed each FY.

            Provides guidelines for districts to apply for teacher performance pay grants.

HB 2927 by Rep. Coody, R-Lawton, Sen. Ford, R-Bartlesville.

            Provides for emergency exemptions for FY10-11 if there is a reduction in total revenue of 4% or more from preceding year.  Schools may not be exempt from         any federal educational-related requirements, health and safety provisions, teacher        salary, retirement or health insurance requirements, the OSTP, the OEIP,  teacher          preparation, examination, licensure, certification, residency and professional development system and curricular standards for the instruction of students.  Such     emergency exemptions shall be granted for no longer than one year.

            Beginning with the 2013-14 school year, each written policy of evaluation for all            teachers and administrators shall be based upon measures of teacher and leader       effectiveness that include quantitative data regarding growth of student learning             and an evidence-based performance rubric.  Also provides change in OK statute           to accommodate guidelines for RTTT, should OK win such award.

HB 2944 by Rep. Jordan, R-Jenks, Sen. Crain, R-Tulsa.

            To the extent possible, court appearances of public school district employees     should be scheduled to minimize the disruption of class time.  If a school district        employee is subpoenaed to appear as a witness in a civil court proceeding, except in a proceeding in which the school district or the state is a party, the school       district shall be entitled to a witness fee equal to the amount of the substitute             teacher cost, not to exceed $100 per day.

Allows districts to exceed class size requirements through FY 2012 with no penalty, takes away requirements for certified library media specialists through FY 2012.  New law grants districts the right to NOT form, convene, or participate in any advisory council or committee.

            Requires SBE to develop a funding mechanism for the disbursement of federal   funds to reimburse LEAs for the excessive costs of high-need students.

            Directs SBE to incorporate April 19, 1995 bombing information into the            Oklahoma history social studies core curriculum.  Also directs the State Textbook          Committee to incorporate criteria on bombing in the evaluation of certain textbooks.

            Increases from 70 to 90 the number of school days that a substitute teacher shall            be employed.

            Restores previous language regarding alternative certification for teachers - from            three to two years of work experience required to be certified.

            Requires SBE to adopt social studies core curriculum with courses of instruction            that include the Declaration of Independence, US Constitution, including Bill of        Rights, substantive selections from Federalist Papers, Emancipation Proclamation,   Gettysburg Address, and George Washington's Farewell Address.

            Requires districts to provide a parental education warning notification to parents             of 5th-7th graders about how critical the middle school grades are to preventing a            student from dropping out of high school.

HB 3030 by Rep. Benge, R-Tulsa, Sen. Newberry, R-Tulsa.

            Amends Teacher Due Process Act in regard to dismissal and suspension for those         teachers on temporary contracts.  (Adds educational services contracts with a state      agency or private entity to those contracts that fall under this category.)  The             House author announced in presentation of bill to committee that this would solve           the problem for Sand Springs PS and its teachers under contract at Rader.

            Deletes current law that allows any member of the OTRS who is absent from the           teaching service because of election or appointment as a local, state or national        education association officer to retain membership in OTRS.

            Creates the School Testing Scheduling Task Force to study the timing of testing             windows in regard to extracurricular events and activities for students.

            Creates the School District Transparency Act.  Will allow public to access         through a statewide website provided by the SDE information regarding       disbursement of state funds, local funds and federal funds.

            Changes date of school board elections from February to the general election date         in November.

Creating the Quality of Education Assessment for Oklahoma Citizens Act of 2010.  Requires elementary and secondary schools to determine citizenship status of enrolled students; requires parents to notify school of citizen or immigration status of child.

            Allows school district to award contracts for the sale of advertising on exterior of           school buses.  (This is bill from 2009 session that was not considered by the         House Common Education Committee until 4-7-10, a year later.)

SB 1617 by Sen. Halligan, R-Stillwater, Rep. Denney, R-Cushing.

Amends current law regarding reporting by school districts on school improvement list for four consecutive years – beginning 12-31-10, and annually each year thereafter, the SDE shall submit a report of the district plans from these particular districts to the members of the Senate and House Education Committees.

            Allows school districts to expend textbook allocations for instructional expenses            for FYE June 30, 2011.

            Allows school districts to expend textbook allocation for instructional expenses for the next two fiscal years (2010-11 and 2011-12).  Also waives penalties for     exceeding class size limitations for the same two fiscal years.

            Allows recognized Indian tribes and cities with more than 300,00 population to sponsor a charter school.

Amends incentive pay plans for teachers to increase year of incentives from 20%  to 50% of the teacher’s regular salary, exclusive of fringe benefits or extra duty pay.

Expands requirements for auditors for public schools to include a minimum of     eight clock hours of continuing education credit in school district accountancy   during the prior year approved by the State Auditor and Inspector.

            Adds language in statute pertaining to weighted average daily membership of      pupils enrolled in online courses - "the weighted membership of pupils enrolled in online courses shall be based on the weighted average daily membership of the        preceding school year."  (Current law bases calculation on the two preceding     school years.)

            Require the SBE to seek approval of the USDE to amend the state accountability          plan to replace the current CRTs with a formative assessment which is aligned to    PASS, measures student growth over the course of the school year through             multiple test administrations, tracks student growth over multiple years, and        utilizes a dynamic, adaptive, computer-based test format.

Requires school districts to report the percentage of students in the district enrolled in college preparatory/work ready curriculum and in the core curriculum.  Districts with 15% or more students enrolled in the core curriculum shall submit a plan outlining the steps the district is taking to reduce the percentage of students enrolling in the core curriculum.  (Students on IEPs exempted from this requirement.)
